On July 16, 2019, CBFANC Board Member Evey Hwang offered comments to the Oakland City Council regarding the proposed Oakland A's Stadium & residential development at Howard Terminal.  Because there were other agenda items on July 16th, the Howard Terminal issue did not come up at the meeting until about 11 p.m.  When finally given the opportunity to speak, Evey was brief, and concise.  Thank you, Evey, for your hard work and dedication of many hours on behalf of the betterment of our industry.

Over the years, Brenda Custer-Espeleta has served multiple terms as a Director of CBFANC.  She also has been a participant and contributor to the activities of the Pacific Coast Council (PCC) and she has repeatedly conveyed our industry’s concerns to Congress as a member of the CBFANC delegation to the annual PCC Mission to Washington, D.C.   Brenda continues her work for the greater good by currently serving as Director, Area 6, of the National Customs Brokers & Forwarders Association of America (NCBFAA).

Currently VP Customs Compliance at Flexport, Brenda is a licensed Customs Broker with over 30 years of experience in the ever-changing environment of trade regulations.  Brenda has held various roles in both small and large companies working her way up from data entry at a family owned customs broker; to overseeing one of the top ten brokerage operations in the US as VP Customs Operations at CEVA Logistics.  She is also well versed in Foreign Trade Zone operations and regulations having set up four zones and drafting the compliance and operational procedures.  She has served as a global compliance advisor for a power amplifier company traveling overseas to set up their global compliance practices, and assisting getting their product into some of the most protectionist of countries.

  1. CBP Outbound:
  1. More penalties being issued by CBP for outbound shipments: Update from our last meeting is that what we believed as Jim Swanson and Thomas Overacker could make a call and take care of some of the ridiculous fines and penalties on exports, we were not correct.  There is a law out there that prohibits Tom or Jim to contact any FP&F office and ask for relief.  In fact, if they do conduct any act like it, they are in violation of the law and could lose his job.   
  2. Export Advanced Manifests:  COAC’s Export Working Group is focused on getting processes going and will most likely be leading the fight on pushing this issue with the idea that post-departure filing can come back.

Each month we ask a member of our board or an officer of CBFANC to tell a little about themselves.  They kindly answer a list of questions that we hope will give you insight into their  dedication and desire to serve for the greater good on behalf our our industry.
This month, we feature Chris Ramos of KSI Corporation.  Chris is the current President, and a board member..


What was your first job? Mc Donald’s - Two all-beef patties, special sauce, lettuce, cheese, pickles, onions on a sesame seed bun (try saying that 5 times fast!). At $3.35/hour, with no bills to pay, during my sophomore year in high school – I felt like I was millionaire.
How did you get into the logistics business? I wish I could say I had a plan, but more like I needed a job!
If you could be anywhere right now, where would you be?  Laying on the beach, somewhere in the South Pacific Island, surrounded by family, while sipping a Mai-Tai.
Briefly, what is your goal as a director or officer of CBFANC? World Peace and Prosperity for All!  Kidding aside, my goal is to be able to share ideas and knowledge, amongst all of our membership, on a regular basis, so that we can all benefit and grow from our experiences both individually, as well as collectively.

 

Update on CES Progress

 Update on CES Progress:   A year ago July 2018 PCC Logistics became the secondary CES for Oakland Port.   In April 2019 PCC Logistics became the sole Customs Examination Site.   Since early May 2019, CBFANC Customs and Ocean Committees have met with PCC Logistics and CBP to follow up on our concerns regarding the CES and its progress.    Our July 30th meeting followed up on issues such as exam turnaround times and PCC’s in/out gate charges.    
 
CBFANC membership has been heard.   Effective August 1, 2019, PCC Logistics is effecting a fundamental change to their gate charges.  Of significance, there is opportunity for only one out-gate fee ($80) and no in-gate fees for outside (Broker assigned) truckers arriving with completed interchange documents.

The fight continues to protect the Port of Oakland from commercial real estate developers

Howard Terminal Ballpark news:   The fight continues.  On July 16th, CBFANC joined members of ILWU, port truckers and other port stakeholders at a City of Oakland City Council general meeting.  CBFANC is a member in the East Oakland Stadium Alliance in efforts to convince the City of Oakland that it should not allow the Oakland As to build a Major League Ballpark at Howard Terminal.   The As organization has done everything it can  to circumvent established review processes to advance their true aspirations – real estate development.   The Bonta Bill AB1191 allows fast-track of state land through BCDC oversight and is expected to pass in Sacramento.   Part of the “deal” requires the City of Oakland’s to do the clean-up of the Howard Terminal site--a location which historically has had heavy industrial use.  Oakland’s governing body was kept in the dark about completed port studies regarding the proposed As stadium.  Further, a brochure containing a prospectus page regarding the ballpark was placed on the agenda of the June 27th meeting of the SF Bay Conservation & Development Commission (BCDC).  All this is despite the City Council’s having not yet taken a vote on the ballpark!  Who is in charge here?????    http://www.bcdc.ca.gov/seaport/meetings.html
 
The coalition also recently sent formal request to Oakland Port Commissioners for them to seek the engagement of maritime interests.  CBFANC will join other Port stakeholders to voice concerns on the viability of a ballpark within the Port's vicinity.    We will continue our message that maritime interests are not being protected or considered.

The US -China trade relationship is changing in ways that are defying expectations. As the US adapts, we are seeing far reaching impacts on our domestic economy - although it is too soon to know whether these will be positive or negative in the long term.

The tariffs have accelerated the trend which already existed: the transition of sourcing away from China to other countries, such as Vietnam, and even further afield. But the pace is even faster than most expected.

NEW CBFANC Broker's Exam Prep Course now in session!

INSTRUCTOR OF THE NEW CBFANC BROKER'S EXAM PREP COURSE

Keith Hwang, CHB, JD is the instructor for the October 2019 Customs Broker License Examination (CBLE) prep course which began on July 9th. 

 

With degrees from Yale (BA), Columbia (JD) and Stanford (MA), Keith's academic credentials are impressive, but according to him, the most relevant qualification he has is a passion for teaching.  "I view teaching as an opportunity to explore a particular topic with others in search of an understanding or insight from which we can all benefit," he says.  "It's just as much facilitation of a learning process as it is straight instruction."

 

Keith brings more than 10 years of experience as an instructor for the broker license exam, an equal amount of time as a practicing customs broker supervising entries for a wide range of commodities and entry circumstances, and, as a licensed attorney, a skill set exactly suited for interpreting and explaining the often complicated and counter-intuitive regulations tested on the exam.  In connection with joining the CBFANC's educational offerings, Keith has also significantly revamped his course, improving the materials and website and making it available to distance learners as well as in-person students.

 

CBFANC will announce the registration dates and requirements for the next CBLE course when the details become available.  Stay tuned!

Editor's note:  We are continuing to include this article in our newsletter because it contains very important facts about the value of the Port of Oakland as a fully operational maritime port. The proposed development of Howard  Terminal as an A's ballpark threatens the viability of the port and would severely compromise it's future. The port's impact on our industry and the economy of California cannot be understated and it should be protected.
